The Railways Act 2005 transferred rail powers to specify and manage the ScotRail franchise to Scottish Ministers.
The ScotRail franchise is monitored and managed by Transport Scotland on the behalf of Scottish Ministers. The former signatories were the Strategic Rail Authority which was abolished by the Railways Act 2005 and Strathclyde Passenger Transport Executive (SPTE) whose rail powers were transferred to Scottish Ministers under the Transport (Scotland) Act 2005. For clarity, where the words Authority or SPTE appear in this document these should be taken as meaning Scottish Ministers.
Scottish Ministers are now responsible for the monitoring of the Public Register under the Railways Act 2005.

Definitions Agreement
This is an agreement among the Strategic Rail Authority (the Authority), the Strathcyde Passenger Transport Executive (SPTE) and First ScotRail Limited (the Franchisee) relating to the interpretation of this Agreement, the Conditions Precedent Agreement and the Franchise Agreement.
The ScotRail Franchise Agreement and Amendments
An agreement among the Authority, the SPTE and the Franchisee relating to the ScotRail Franchise.
The ScotRail Franchise Extension
The Heads of Terms is an Amendment Agreement between Scottish Ministers and First ScotRail amending the Franchise Agreement.
SQUIRE Service Schedule Agreement
This is an agreement among the Authority, the SPTE and the Franchisee relating to service quality standards for the ScotRail Franchise.
Conditions Precedent Agreement
This is an agreement among the Authority, the SPTE and the Franchisee specifying certain conditions to be satisfied prior to issue of a Certificate of Commencement.
Authority Service Level Commitment
Under Schedule 1.1 of the Franchise Agreement, the Authority is entitled to issue from time to time a Service Level Commitment which details the levels of service provision by the Franchisee on its routes.
SPTE Service Level Commitment
This section sets out the service patterns, early and late services and maximum journey times for route services delivered in the Strathclyde region.
