Legislation

Administration of the Blue Badge scheme must be based on the legislation. It is important for local authorities to be familiar with the requirements.

The disabled person’s badge scheme was introduced in 1971 by section 21 of the Chronically Sick and Disabled Persons Act 1970. The Principal Regulations are The Disabled Persons (Badges for Motor Vehicles) Scotland Regulations 2000 (as subsequently amended).

Read legislation for the Blue Badge scheme in Scotland at the UK government site:

The Disabled Persons (Badges for Motor Vehicles) Scotland Regulations 2000
Amendment Regulations 2000 (pdf 66KB)
Amendment (No. 2) regulations 2000
Amendment Regulations 2002
Amendment Regulations 2007
Amendment Regulations 2011

Amendment No. 2, Regulations 2011

Transport Scotland notified local authorities on the legislative changes:

Police officers, traffic wardens and, on some occasions, council workers may inspect Blue Badges. Use this leaflet to help Blue Bage users understand their rights and responsibilities.
